Terms of Service

1. Agreement to Terms

By accessing or using the Budgley web application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree to these Terms, please don't use the Service.

These Terms constitute a legally binding agreement between you and Budgley Software LLC ("Budgley," "we," "our," or "us").

2. About Budgley

Budgley is a web-based personal budgeting application that helps users plan, track, and manage their household finances. It is operated by Budgley Software LLC, a company based in Minnesota. Budgley is not a financial institution, bank, investment advisor, or credit service. The Service is a productivity tool only.

3. Account Requirements

To use Budgley, you must:

• Be at least 18 years of age.
• Provide accurate and complete registration information.
• Maintain the security of your account credentials and not share your login with others.

If you wish to give another person access to your budget, use the shared access invite code feature — don't share your account password. Each invite code grants the recipient access to view and edit your budget data. You are responsible for any activity that occurs under your account.

You may create one account per person. Creating multiple accounts to circumvent trial limitations or other restrictions is not permitted.

4. Free Trial & Subscription

Budgley offers a 30-day free trial for new accounts. During the free trial, you have full access to all features of the Service.

A valid payment method (credit or debit card) is required to start your free trial. You will not be charged during the 30-day trial period. We will send you a reminder email before your trial ends.

After the 30-day trial period, your subscription will automatically begin at $4.99 per month unless you cancel before the trial ends.

5. Billing & Cancellation

Subscription fees are billed monthly to the payment method on file, processed through our third-party payment processor. You authorize us to charge your payment method on a recurring monthly basis until you cancel.

You may cancel your subscription at any time from your account settings — no phone calls required. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until that date. We do not offer refunds for partial billing periods.

Prices are subject to change. We will notify you at least 30 days before any price increase takes effect.

6. Your Content

All budget data, expense entries, categories, notes, and other content you create in Budgley ("Your Content") belongs to you. Budgley claims no ownership over Your Content.

You grant Budgley a limited, non-exclusive license to store and process Your Content solely for the purpose of operating and providing the Service to you. We will not use Your Content for any other purpose.

You are responsible for the accuracy of data you enter. Budgley is a tool — it doesn't verify the correctness of your inputs.

7. Bank Statement Imports

The weekly true-up feature allows you to upload or paste a bank statement to identify transactions you may not have logged manually. When you do this:

• The statement data is processed in your active browser session to identify gaps between your logged expenses and your bank transactions.
• This data is processed immediately and is not transmitted to Budgley's servers.
• Budgley does not store, index, retain, or otherwise keep any bank transaction data beyond the active processing session.
• Your bank credentials are never requested, collected, or stored by Budgley.

8. Acceptable Use

You agree not to use the Service to:

• Engage in any illegal activity or violate any applicable laws.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Scrape, crawl, or use automated tools to access the Service without our written permission.
• Attempt to gain unauthorized access to other users' accounts or data.
• Abuse, misuse, or exploit the shared budget access feature to access data without the account holder's consent.
• Use the Service in a way that could damage, disable, or impair it.

Violations may result in immediate termination of your account.

9. Service Availability

We provide the Service on an "as is" and "as available" basis. We aim for high availability but do not guarantee uninterrupted or error-free service. We are not liable for downtime, data loss due to technical failures, or service interruptions outside our reasonable control.

Budgley is not a financial advisor. Nothing in the Service constitutes financial, investment, tax, or legal advice. Information provided by the app is for personal budgeting and planning purposes only. Always consult a qualified professional for important financial decisions.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Budgley Software LLC and its officers, employees, and agents are not liable for:

• Any financial decisions, outcomes, or losses resulting from your use of the Service or reliance on information presented in the app.
• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of data due to technical failures (we recommend exporting your data regularly as a backup).

In any case, Budgley's total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the total fees you paid to Budgley in the 12 months prior to the event giving rise to the claim.

11. Account Termination

You may close your account at any time from your account settings. Upon closure, your data will be deleted within 30 days.

Budgley reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the Service. We will notify you by email before taking such action when possible, unless the violation requires immediate action.

12. Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Minnesota.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we'll notify you via email at least 14 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

If you don't agree to the updated Terms, you may cancel your account before the effective date.
